OAKLAND, Md. (AP) - An Accident man will be tried on first-degree murder charges in connection with the shooting death in December of a Pennsylvania man.
Norris Wayne Rush, 51, was charged with first-degree-murder and using a handgun in a crime of violence in the shooting death of David Wayne Lancaster, 29, of Saltzburg, Pa.
State's attorney Lisa Thayer Welch said visiting Judge Paul Stakem found probable cause to move the case to Circuit Court.
Police first called the shooting on Dec. 3 self-defense. According to police reports, Rush, Lancaster and Billie Jo Zimmerman, Lancaster's former girlfriend, were in Rush's home and were very drunk when Lancaster allegedly stuck a butcher knife into Rush's hand.
Rush then reportedly fired a .22-caliber handgun three times at close range, striking Lancaster in the stomach and chest, killing him.
Rush was arrested on Oct. 4.
